What a public offer is
Article 395 of the Civil Code: a proposal addressed to everyone that contains all essential terms of a contract is a public offer. Paying for an order on the site accepts it.
For an online store or online service, the offer is the contract with the buyer.
What to include
- Seller: name, BIN/IIN, address, contacts in Kazakh and Russian.
- Goods or service and the price in tenge.
- How ordering, payment and delivery work, with timelines.
- Returns and exchanges: deadlines and how to apply.
- Liability and dispute resolution.
- A link to the privacy policy.
Where to place it
- As a separate page, e.g. /offer or /terms.
- Linked in the footer and in the cart before the pay button.
- With an “I accept the offer terms” checkbox at checkout.

Does a business card site need an offer?
If nothing can be ordered or paid for on the site, an offer is not required. A privacy policy and contacts are enough.
Does the offer replace a contract with a company?
For individual buyers the offer is the contract. Large deals with companies usually get a separate signed contract.
