What counts as misleading advertising
Text on a company website is advertising too when it sells a product or service.
- “Best”, “No. 1”, “cheapest”, “market leader” without a study or ranking you can cite.
- “Guaranteed results”, “100% effect” where the outcome is not up to you.
- Discounts and offers that do not exist, or “from ₸990” when nothing costs that.
- Reviews and figures that cannot be verified.
Fines under Article 455
- Part 2, unfair and misleading advertising: small business — 100 MCI (₸432,500), medium — 200 MCI (₸865,000), large — 400 MCI (₸1,730,000).
- Part 5, repeated within a year: 250 MCI (₸1,081,250), 350 MCI (₸1,513,750), 650 MCI (₸2,811,250).
- Part 1, advertising something that may not be advertised: 120, 170 and 450 MCI (₸519,000, ₸735,250 and ₸1,946,250).
How to write it without fines
Concrete numbers also sell better and are quoted by AI search more often than general claims.
- Instead of “best”, be specific: “delivery in 2 hours across Almaty”, “12 years on the market”.
- If you claim “No. 1”, name the ranking and year and link to it.
- Put offer terms and dates next to the offer, not in small print elsewhere.
